National Virtual Library of India (NVLI) has been set up by Ministry of Culture, Government of India, vide notification no. 18-4/2009_lib (Pt) dated 4th May, 2012 in pursuance of National Knowledge Commission recommendations for sustained attention for development of Libraries and Information Science Sector. The purpose of NVLI is to facilitate a comprehensive database on digital resources on information about India and on information generated in India. NVLI, a comprehensive database, presents the huge digital data in an organized and user-friendly way with multilingual services.

As and when required we will update or modify this “Terms of Service & Policies Document”. At the top right corner of this document we have mentioned the date, “Last updated”, which will indicate the effective date. This is the latest version of this “Terms of service & policies” for your perusal. You can refer previous versions in an archive.

Terms & Conditions
This document explains “Terms & Conditions”. A simple heading summary is given for a quick overview of the paragraphs following. These summaries are not part of the official legal “Terms & Conditions”.
NVLI aggregates content owned by others. “Users” must follow all legal compliances including moral rights with respect to the usage of these content
The responsibility of NVLI is to aggregate, curate, organise, and present content. The content is not owned by NVLI. The Intellectual Property rights and the ownership and all other rights of such content are with the respective owner. All “Users” of our site are required to go through the policies, terms & conditions and any such legal arrangements related to such content very carefully. Some of the content acquired and hosted by us can be Open Educational Resources (OER) and/or under open Licenses such as Creative Commons. All “Users” are required to verify such licenses or any other legal instruments in force with the owner or concerned authority before copying, downloading or re-using the content in some other manner. “Users” should perform all due diligence before actual usage of such content. “Users” should not modify, adapt any content which will hamper “moral rights” of the author. NVLI will not be liable for any legal action, enforcement or claim for damages initiated by the content owner in case of misuse of the content.
Metadata curated NVLI may not be accurate
NVLI takes reasonable care to curate the above mentioned content, and ensure that the metadata related to a content, such as the title, year, copyright, classification, etc is accurate. The metadata is created for the convenience of the “Users” and for easy discovery and access of the content. NVLI is not responsible for any loss or damage owing to errors or omissions in the content or metadata displayed.
Users must not modify the usage rights set by the respective content owner
“Users” will have to ensure compliance with and are not allowed to modify any legal notices, intellectual property usage terms and conditions, or any agreements, Terms of Service and Privacy policies displayed on this “site” or presented along with any content displayed on our “Site”. All “Users” will need to ensure adherence to the terms of the License as specified by the Content Owner. NVLI will not be liable for any legal action, enforcement or claim for damages initiated by the content owner.
Content displayed may not be suitable or complete
Mostl content is displayed or hosted on the NVLI “Site” as received. Some content may be displayed after reasonable modification for the convenience of the “Users”. NVLI is not responsible for its quality completeness or suitability for your purposes. The content may be obscure, provocative, limited for use of defined audiences, promotional, offensive, disturbing, weird, misleading, fraudulent, or otherwise objectionable. There may be some content of which usage requires supervision by elders, mentors, and teachers or guardians. “Users” are required to follow the guidelines or directions for usage of the content if any mentioned by the content owner. NVLI will not be liable for any damage caused due to usage without proper directions. “Users” are advised to check the accuracy, completeness and suitability of the content for their purposes. They are also required to follow the guidelines, legal status, access policy, IP policy, terms and conditions, rules and regulations and all other like information before usage of the content. It is the sole responsibility of the “User” to take all due precautions while assessing such information.
Content displayed on the site may not be permanent
While a reasonable care is taken to ensure permanence of the content displayed, NVLI may change, add, remove some content at its discretion and hence does not guarantee the uninterrupted, error free availability of the content.
Users are responsible for the security of their devices and data
NVLI will follow standard security protocols and take reasonable precautions to protect the “Site” from any cyber attacks. We do not, however, hold out any guarantee (either express or implied), that such attacks will never happen. “Users” are required to ensure that their own devices are safe from any cyber attack of any kind and from any source. “Users” should take due precautions while downloading or accessing the content. We are not responsible or liable for any damage due to such unexpected events.
“Users” must ensure fair or non-infringing use of content and confidentiality of login credentials
By accessing our “Site”, “Users” declare that the content of the “Site” will be accessed and used for fair or non-infringing use. “Users” also declare that they will not violate any policy, rules, regulations which will attract any legal liability and action. “Users” are required not to interfere with the work of other “Users” or NVLI personnel, servers, or resources. In their own interest, “Users” are required to maintain the confidentiality of their login ID and password and not share it with others.
Using our services does not give the “Users” any right over content or service we are providing.
User accounts may be deactivated
NVLI at its sole discretion at any time by written notice (including email or notice on the “Site”) may immediately deactivate any user login or password it has issued and debar a “User” from accessing the “Site”.
Use of names and logos is restricted
Use of “NML”, “National Mission on Libraries”, “NVLI”, “National Virtual Library of India” and its logos, seal and any variations thereof is not allowed without prior consent, except for the purposes of attribution as required by our “Creative Commons License, CC BY 4.0”. Any use which indicate the endorsement by “NML”, “National Mission on Libraries”, “NVLI”, “National Virtual Library of India” or any use for promotion or commercialization or any such activity which certifies the relationship of “NML”, “National Mission on Libraries”, “NVLI”, “National Virtual Library of India” is strictly prohibited.
Users agree to not hold NVLI responsible for their loss, damage, etc.
“Users” of this “Site” agree to indemnify and hold harmless “NVLI” and its employees, subsidiaries, affiliates, agents, officers, directors, from and against any and all liability, loss, claims, damages, expenses (including, but not limited to reasonable attorneys' fees), and/or actions, arising out of /related or incidental to use of or the inability to use the “Site” contents provided/edited/changed/updated/ or resulting from unauthorized usage by the “Users” on this “Site”. Under no circumstances, including, without limitation, negligence, shall the “NVLI” or its associates be responsible and liable to “Users” for any direct, indirect, incidental, consequential, special, and exemplary or direct or indirect damages, remote loss/damage of any kind including but not limited to loss of data, loss of goodwill, or other intangibles, loss of revenues, loss of profits, loss of business, loss of opportunities, loss of health, loss of reputation etc., even if it has been advised of the possibility of such damages.
These “Terms of Service & Policies” shall be governed by appropriate laws of India
